BidYatra Legal Framework

1. Acceptance of Protocol: By accessing or using BidYatra (Android app, website, or associated mobility interfaces), you agree to comply with and be bound by these Terms & Conditions. BidYatra operates as an open digital marketplace facilitating direct fare bidding and coordination between independent riders and verified vehicle operators (Bike, Toto, Tempo, Car, SUV).

2. Nature of Platform Services: BidYatra does not operate as a traditional transport provider or direct taxi fleet operator. Instead, it provides a high-speed telemetry and open bidding protocol. All journey contracts, transit operations, and fare settlements are directly established between the Rider and the Driver Partner.

3. User Accounts & Conduct: Users must provide accurate mobile verification details and maintain a secure device environment. Any fraudulent bookings, misuse of the 4-digit start PIN verification, or harassment of drivers/riders will result in permanent suspension from the network.

4. Limitation of Liability: BidYatra facilitates communication, route telemetry, and bidding logs. While we perform rigorous document verification for all drivers, BidYatra is not directly liable for unforeseen transit delays, personal belongings left in vehicles, or disputes arising outside direct settlement terms.

1. Information Collection: To deliver seamless pickup, drop navigation, and bidding performance, BidYatra collects essential device location data, registered phone numbers, profile information, and ride telemetry (One-Way, Round-Trip, Scheduled).

2. Geo-Location Tracking: Precise real-time GPS tracking is active solely during active app sessions and ongoing trips to ensure accurate driver-rider matching, ETA calculations, and travel security. Background tracking is strictly disabled when offline.

3. Data Sharing & Security: Personal contact numbers are masked or protected during active communication between riders and drivers. We do not sell or lease user data to third-party advertisers. Data is encrypted in transit using industry-standard protocols.

4. User Rights: Users retain the absolute right to request profile data export or account deactivation directly through the app interface or by contacting our compliance division.

1. Zero Surge Bidding Model: BidYatra rejects automated algorithmic surge pricing. Fares are determined transparently through real-time market bids submitted by nearby verified drivers. Once a bid is accepted by the rider, the fare is firmly locked with zero hidden additions.

2. Direct Settlement Protocol: All financial settlements occur 100% directly between the rider and driver upon successful trip completion at the drop destination via Hand-to-Hand Cash or direct scan of the driver's personal UPI QR code.

3. Rider & Driver Fee Structures:
• Rider Fees: All standard rider fares inclusive of applicable 5% rider GST.
• Driver Fees: Driver partners are subject to a 5% platform charge plus an additional 18% GST payable on the platform charge.

4. Cancellation Guidelines:
• Standard One-Way / Round-Trip Cancellation: Free cancellation is permitted within 2 minutes of bid acceptance, or if the driver's arrival ETA exceeds initial estimates by more than 5 minutes.
• Scheduled Bookings Cancellation (> 24 Hours): Full 24-hour advance cancellations are eligible for a 100% full refund.
• Scheduled Bookings Cancellation (< 24 Hours): Cancellations made within 24 hours of the scheduled pickup are non-refundable. Payouts to the driver (where applicable) will be processed after deducting applicable fees.
• Driver Cancellation: Drivers may withdraw offers prior to PIN confirmation if vehicle technical issues arise, without incurring platform penalties.

1. Government Permitted Fleet Compliance: All vehicles registered and operated on the BidYatra network (Bikes, Totos, Tempos, Cars, and SUVs) must possess valid government-issued permits, commercial registration, up-to-date insurance, and adhere strictly to regional transport regulations.

2. Vehicle Authorization & Verification: Fleet owners must verify and authorize driver profiles via secure 4-digit OTP verification before any vehicle dispatch.

3. Partner Independence & Autonomy: All operators retain full autonomy to accept or decline ride offers through the open bidding protocol.

4. Direct Earnings & Fee Structures: Drivers retain agreed fare settlements collected directly via cash or digital UPI upon trip completion, subject to a 5% platform charge plus an additional 18% GST payable on the platform charge.

5. Strict Zero-Tolerance Substance Policy: Driver partners are strictly prohibited from consuming or being under the influence of alcohol, intoxicants, or prohibited substances while on duty or logged into the platform. Upon receiving a verified rider complaint regarding substance use, BidYatra reserves the immediate right to suspend or permanently terminate the driver's account.
